§ 4-1-4-1. DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   (A)   AUCTION. A sale transaction conducted by means of oral or written exchanges between an auctioneer and the members of his or her audience, which exchanges consist of a series of invitations for offers for the purchase of goods or real estate made by the auctioneer and acceptance of the highest or most favorable offer made by a member of the participating audience.
   (B)   FIRE AND OTHER ALTERED GOODS SALE. A sale held out in a manner so as to reasonably cause the public to believe that the sale will offer goods damaged or altered by fire, smoke, water or other means.
   (C)   GOING-OUT-OF-BUSINESS SALE. A sale held out in a manner so as to reasonably cause the public to believe that, upon the disposal of the stock of goods on hand, the business affairs of the person, firm or corporation will cease and be discontinued.
   (D)   GOODS. Any goods, wares, chattels, merchandise or other personal property, including domestic animals and farm products.
   (E)   SPECIAL SALE. The sale of or an offer to sell to the public goods of any kind in connection with a declared purpose on the part of the seller that the sale is anticipatory to the termination, closing, liquidation, revision, wind-up, discontinuance, conclusion or abandonment of the business in connection with the sale. It shall also include, but is not limited to, any sale advertised to be a creditor’s sale, executor’s sale, administrator’s sale, salvage sale, assignee’s sale, receiver’s sale, loss-of-lease sale, fire sale, moving sale, relocation sale, going-out-of-business sale and all other sales advertised in a manner so as to reasonably convey to the public that the person conducting the sale will cease and discontinue business at the place of sale upon disposal of the stock of goods on hand and then will move to and resume business at a new location or then will continue business from other existing locations.
