(A) If a notice of violation is issued under § 3-3-13-3 to a manager or to an owner if the property that is being actively occupied and properly maintained, the manager or property owner may submit to the department a written request for an extension of the time for good cause. Good cause shall include, but not be limited to, financial hardship to the owner.
(B) The department will establish the manner, method, and form in which such requests must be made. The department will also establish a reasonable and non-discriminatory policy to establish the criteria by which requests for extension of time may be approved, and penalties may be waived.
