§ 3-1-3-2. APPOINTMENTS; RANK.
   (A)   The Fire Chief shall be appointed by the Mayor.
   (B)   Up to two deputy chiefs shall be appointed by the Mayor.
   (C)   Up to five division chiefs shall be appointed by the Fire Chief.
   (D)   Up to three battalion chiefs shall be appointed by the Fire Chief.
   (E)   All other appointments, positions of rank, which shall include probationary firefighter, firefighter, lieutenant and captain, and promotions within the Department shall be made according to the merit system as provided under Chapter 3.5 of Title 3, Article 1.
