§ 1-2-8-2. USE OF VEHICLES BY POLICE PERSONNEL.
   Subject to the approval and authorization of the Chief of Police and the Board of Public Works and Safety, specific sworn Police Department personnel identified by rank or function or all sworn Police Department personnel and civil police personnel may be assigned and provided an exclusive use, take-home marked or unmarked City and Police Department personal transportation automobile or other motor vehicle, including animal control vehicles. This provision shall not apply to any specialized function vehicle such as a prisoner transport vehicle and other such specific purpose vehicles except for animal control vehicles. These vehicles, upon and subject to the approvals specified above, may be used exclusively by the assigned officer or officers and may be driven by them, but only by them, except as otherwise specifically authorized by the Chief of Police, for on-duty service as well as for personal and off-duty transportation at any and all times within the State of Indiana. All such availability and use, if and when approved and authorized as herein provided, shall represent a public benefit and availability for the City and the public and not a benefit or entitlement of the officers. All other sworn and civil police personnel shall use one or more automobiles or other personal transportation motor vehicles which are assigned to the Department and which are a part of a motor vehicle pool only during the performance of their official duties and while they are actively performing the duties and functions of their employment.
