§ 1-2-5-16. RETIRED EMPLOYEE INSURANCE BENEFITS.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   ELIGIBLE PARTICIPANT. An employee, spouse and/or dependent of a retired employee who participated in the City’s health coverage plan as defined by the terms and conditions of the plan in effect for active employees. However, a spouse of a retired employee who has access to health insurance through his/her employer is not eligible.
      (2)   RETIRED EMPLOYEE. An employee who has fulfilled a minimum of 20 years of employment service with the City of Lawrence, the employment service has terminated for any reason whatsoever and the employee is an eligible participant in the group health plan in effect at the time of termination.
   (B)   Effective January 1, 2014, any retired employee under the age of 65 may remain on the health plan provided to active employees with 100% of the cost payable by the retired employee or, at the retiree's option, the City will provide a yearly cash stipend. The amount of the stipend will be determined each year by the City.
   (C)   Medicare will become the primary payer for any participating retired employee who attains the age of 65. The City’s health plan will become the secondary payer for the retiree. When the retired employee or spouse attains the age of 65, he or she has the option participating in a Medicare Supplement through the City’s health plan.
