§ 1-2-4-10. OVERTIME; COMP TIME.
   (A)   This section applies to all paid City personnel.
   (B)   Overtime work is officially discouraged, and no employee may work overtime without the express authorization of his or her department head or supervisor. Employees who work unauthorized overtime will be compensated for that time, but will be disciplined, up to and including termination of employment.
   (C)   Where a department head or supervisor requires a non-exempt employee to work in excess of his or her regularly scheduled hours on any day, that employee may be paid overtime computed at one and one-half times his or her full hourly rate (base rate plus tech pay, shift differential, longevity, college incentive pay and other included compensation) of pay for all hours worked over his or her regularly scheduled number of hours. Department heads, supervisory personnel and other employees who have been determined as exempt from FLSA overtime laws shall not be entitled to overtime pay, but will receive compensatory leave equal to one hour for every one hour worked.
   (D)   The following shall not be included in calculating overtime for all employees except civilian paramedics and EMTs: vacation leave, holiday leave, sick leave, personal leave, compensatory leave and any other hours paid but not actually worked. Other hours not included, without limitation, are as follows: on-call time if the employee is permitted to use a beeper or other communication device, unpaid suspension time, and personal time spent at commendation ceremonies or as a candidate for promotion or other selection process.
   (E)   Civilian paramedics and EMTs who work 24-hour shifts shall be paid overtime or receive compensatory leave for all hours scheduled over 40 hours in a week, regardless of whether or not they actually work those hours, as long as any hours not worked are taken as paid leave.
   (F)   Overtime hours for police officers shall include actual court time, travel time of no more than one hour when the shift begins or ends more than one hour before or after the next shift or court time, mandatory training time in Marion County, mandatory training time outside Marion County that occurs during the officer's non-working days, and time spent, if required by the Department, at the firing range, branch meetings, coroner inquests, Board of Public Works and Safety meetings, review board hearings and medical examinations. Officers shall receive a minimum of two hours' compensation for court sessions attended during non-working hours.
   (G)   Police officers who serve as canine handlers shall be paid for one hour at their regular hourly rate for canine care on days when the officer is off duty. If the officer works more than 171 hours in a 28-day payroll reporting period, the officer shall be paid for any hours over 171 hours at a rate one and one-half times the officer's regular hourly rate.
   (H)   Firefighters shall be paid one and one-half of their regular hourly rate for all regularly scheduled hours worked in excess of 212 in a 28-day period.
   (I)   As an alternative to overtime pay, non-exempt employees may elect to receive compensatory leave in lieu of overtime pay. The compensatory leave shall be calculated at the rate of one and one-half hours for each hour of overtime worked. All police officers and firefighters may accrue a maximum of 480 hours of compensatory leave. All other employees may accrue a maximum of 240 hours of compensatory leave. The City reserves the right to substitute payment for accrued compensatory leave, at its sole discretion, at the rate earned by the employee at the time of payment. Compensatory leave may be utilized by the employee, at a time mutually agreeable to the employee and the employee's department head or supervisor, within a reasonable period after the employee so requests, provided it does not unduly disrupt normal operations.
   (J)   Upon termination of employment, any compensatory leave accrued but unused by a non-exempt employee will be paid to the employee at the employee's final regular rate or the average regular rate received during the last three years, whichever is higher. Compensatory leave accrued by an exempt employee will not be paid upon termination.
