§ 1-2-2-7. ORDINANCES AND RESOLUTIONS; REQUIREMENTS FOR ADOPTION.
   (A)   All ordinances and resolutions shall be submitted in writing and filed with the City Clerk with copies to the Mayor, the President and the Vice President of the Common Council at least seven days before a regular meeting and shall be made available to all members of the Common Council at least five days before the meeting.
   (B)   A majority vote of all elected members is required to adopt an ordinance, unless a greater vote is required by statute.
   (C)   All ordinances shall be read two times, either verbatim or by title only, at the discretion of the Common Council, before being passed, and no ordinance shall pass on the same day on which it is introduced unless the provisions of I.C. 36-4-6-13 are complied with, to wit: A two-thirds vote of all the elected members, after unanimous consent of the members present to consider the ordinance, is required to pass an ordinance of the legislative body on the same day or at the same meeting at which it is introduced.
   (D)   First and second readings shall be 30 days or a monthly Council meeting apart unless an urgent necessity requires more rapid passage.
   (E)   Resolutions shall be subject to the same rules and method of introduction as ordinances, except that a resolution may be adopted on first reading and requires only a simple majority of those members present.
   (F)   On the passage of any ordinance or resolution, the yeas and nays shall be taken and entered on the record by the City Clerk.
   (G)   After an ordinance or resolution has been passed by the Common Council and signed by the presiding officer, the City Clerk shall present it to the Mayor and record the time of presentation.
   (H)   Within ten days after presentation to the Mayor, the Mayor shall either approve the ordinance or resolution or veto it by returning it to the Common Council with his or her reasons for the veto. If the Mayor fails to act on the ordinance or resolution within ten days of presentation, it is considered vetoed.
   (I)   Whenever an ordinance or resolution is vetoed by the Mayor, it is considered defeated unless the Common Council, at its first meeting after the prescribed ten-day period, passes the ordinance or resolution over his or her veto by a two-thirds vote of all elected members.
   (J)   If required by statute or if an ordinance prescribes a penalty or forfeiture for a violation, it must be published as prescribed by I.C. 5-3-1 before it takes effect, unless:
      (1)   It is published as a part of this code when this code or any code supplement is published; or
      (2)   There is an urgent necessity, declared by the Mayor, requiring its immediate effectiveness and copies of the ordinance are posted in three public places in each of the council districts.
   (K)   Within a reasonable time after an ordinance or resolution is adopted, the City Clerk shall record it in the book of ordinances kept on file in the City Clerk’s office for that purpose and for public inspection.
