(A) A Department of Public Safety is hereby established which shall be administered by the Board of Public Works and Safety, as prescribed by I.C. 36-8-3-2, and shall be headed by the Mayor.
(B) Four divisions are hereby established within the Department of Public Safety, as follows.
(1) A Police Department is hereby established pursuant to I.C. 36-8-2-2 which shall be headed by the Chief of Police, as prescribed by I.C. 36-8-3-3. The Police Department shall be organized as prescribed by I.C. 36-8-3 and 36-8-4 and shall carry out all of the powers and duties prescribed by statute pertaining to the Police Department.
(2) A Fire Department is hereby established pursuant to I.C. 36-8-2-3 which shall be headed by the Chief of the Fire Department, as prescribed by I.C. 36-8-3-3. The Fire Department shall be organized under I.C. 36-8-3, 36-8-4 and 36-8-12 and shall carry out the powers and duties prescribed by statutes applicable to the Fire Department.
(3) A Division of Communications is hereby established which shall be headed by a Director of Communications. The Division shall be responsible for providing and maintaining all communications for the Department of Public Safety, including the Police Department, the Fire Department and Emergency Medical Services.
(4) A Division of Buildings and Code Enforcement is hereby established which shall be headed by the Building Commissioner, as prescribed by I.C. 36-7-9-3. The Division shall be responsible for carrying out the powers and duties prescribed by I.C. 36-7-2 and 36-7-9 and all other powers and duties prescribed by statute pertaining to the regulation of buildings and construction.
(C) All personnel of the divisions listed in division (B) above shall be included within the Department of Public Safety.
(D) There shall be a Police Pension Board of Trustees to perform certain duties prescribed by I.C. 36-8-6 (1925 Fund) and I.C. 36-8-8 (1977 Fund) concerning the statutory pensions of City police officers.
