§ 1-1-2-5. OFFENSES PUNISHABLE UNDER SEPARATE PROVISIONS.
   (A)   In cases where the same offense is created or made punishable by different sections of this code, the prosecuting officer may elect under which to proceed. However, not more than one penalty or punishment shall be had against the same person for the same offense, provided that assessment for expenses involved in bringing real property into compliance with any ordinance shall not be deemed a penalty or punishment.
   (B)   A suspension or revocation of any license issued by the City for violation of any criminal statute or any statute or ordinance relating to the business licensed shall not be construed as a separate penalty or punishment.
