A. There shall be created a board of appeals and examiners, hereinafter called "board", consisting of five (5) members who:
1. Are qualified by experience and training to pass upon matters pertaining to the technical building related construction codes adopted by the city and set forth and/or incorporated by chapter 1 of this title; and
2. Are not employees of the city.
B. The board:
1. Shall interpret the provisions of the technical building related construction codes adopted by the city and set forth and/or incorporated by chapter 1 of this title.
2. Shall hear and decide appeals where it is alleged there is an error in any notice, order, requirement, decision or determination made by a building official in the enforcement of this title.
3. May recommend new ordinances to the city council.
4. Shall have only those powers expressly set forth herein and in the adopted codes under which it is acting.
5. Shall have no authority to waive requirements of the technical building related construction codes adopted by the city and set forth and/or incorporated by chapter 1 of this title. (Ord. 2013-02, 2-6-2013)
