7-2-4: UNAUTHORIZED VEHICLES ON STREETS:
   A.   Specified:
      1.   Metal Traction Vehicles: No person shall drive a metal traction vehicle on any public street or highway. All such vehicles must be hauled on a rubber tired vehicle or trailer. Smooth metal drummed street rollers used for street repair and upgrading are exempt.
      2.   Weight; Manner Of Driving: No person shall drive a vehicle on any public street or highway in such a manner or because of gross weight or other factors so as to cause damage to the public street or highway.
   B.   Waiver For Permission: Any person having need within the city because of road construction, maintenance or other, for an "unauthorized vehicle", as defined herein, to be used on any public street or highway may petition the city for a waiver of this section. Upon review of the petition by the city, and if said waiver is granted by written permission, the unauthorized vehicle may be allowed upon a public street or highway for the time and scope of work outlined in the written permission provided. Excepting where the highway is a state road, the petitioner must also successfully petition the state.
   C.   Violation; Penalty: Any person violating any part of this section shall be responsible for restitution of all damages and shall be guilty of an infraction, subject to penalty as provided in section 1-4-1 of this code. (Ord., 5-3-1995; amd. 1998 Code)
