4-8-1: EXCESSIVE NOISE PROHIBITED:
It is unlawful for any person to make, continue, or cause to be made or continued in any excess, unnecessary or unusual loud noise or any noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the limits of the city.
   A.   It shall be unlawful to sound any horn or signaling device on any automobile, motorcycle or other vehicle for an unnecessary or unreasonable period of time including the use of any horn, whistle or other device operated by engine exhaust.
   B.   It shall be unlawful to play, operate or use upon a public street or highway any device of the type commonly known as a sound truck, loudspeaker, sound amplifier, radio, CD or cassette with more than a standard sound amplifier or any other instrument of similar kind or character which emits loud and raucous noises and is attached to or upon any vehicle operated or standing upon any street or highway which can be heard from a distance of one hundred feet (100').
   C.   No driver of any vehicle shall permit the vehicle to emit any excessive or unusual noises or annoying smoke.
   D.   The using, operating or permitting to be played, used or operated in residential areas of any television, radio, musical instrument, phonograph or other machine or device for the producing or reproducing of sound in such a manner as to disturb the peace, quiet and comfort of neighboring inhabitants. If the volume is louder than necessary between the following times it shall be deemed in violation:
      1.   Between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M.
      2.   At any other time when the volume of such device can be heard at a distance of one hundred feet (100') from which it is located.
   E.   Yelling, shouting, hooting, whistling or singing on the public streets, particularly between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M. as to annoy or disturb the quiet, comfort or repose of persons in any dwelling, hotel or other type of residence.
   F.   The operation of any garbage pickup, in any area zoned residential between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M.
   G.   The operation of any power mower, cultivator, or the like or related devices in areas zoned residential between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M.
   H.   The erection, including excavation, demolition, alteration, or repair of any building other than between the hours of six o'clock (6:00) A.M and ten o'clock (10:00) P.M., except in case of urgent necessity in the interest of public health and safety.
   I.   The creation of loud and excessive noise in connection with loading and unloading any vehicle or the opening destruction of bails, boxes, crates and other containers. (Ord. 2004-06, 3-3-2004)
