1-5-3: MAYOR AS MEMBER OF CITY COUNCIL:
   A.   Presiding Officer; Mayor Pro Tempore: The mayor shall be the chairperson and preside at the meetings of the city council. In the absence of the mayor, or because of his inability or refusal to act, the city council may elect a member of the city council to preside over the meeting as mayor pro tempore, who shall have all the powers and duties of the mayor during his absence or disability. The election of a mayor pro tempore shall be entered in the minutes of the meeting.
   B.   Voting; No Vote Except In Tie:
      1.   Except as provided in subsection B2 of this section, the mayor is a nonvoting member of the city council.
      2.   The mayor votes as a voting member of the city council:
         a.   On matters where there is a tie vote of the other council members present at a city council meeting; and
         b.   When the city council is voting on: 1) whether to appoint or dismiss a municipal manager; or 2) any ordinance that enlarges or restricts the mayor's powers, duties, or functions.
   C.   Powers And Duties:
      1.   The mayor shall:
         a.   Keep the peace and enforce the laws of the municipality;
         b.   Ensure that all applicable statutes and municipal ordinances and resolutions are faithfully executed and observed;
         c.   If the mayor remits a fine or forfeiture under subsection C2 of this section, report the remittance to the council at the city council's next meeting after the remittance;
         d.   Perform all duties prescribed by statute or municipal ordinance or resolution;
         e.   Report to the city council the condition and needs of the municipality; and
         f.   Report to the city council any release granted under subsection C2 of this section.
      2.   The mayor may:
         a.   Recommend for council consideration any measure that the mayor considers to be in the best interests of the municipality;
         b.   Remit fines and forfeitures;
         c.   When and if necessary, call on residents of the municipality over the age of twenty one (21) years to assist in enforcing the laws of the state and ordinances of the municipality;
         d.   Release a person imprisoned for a violation of a municipal ordinance;
         e.   At any reasonable time, examine and inspect the official books, papers, records, or documents of: 1) the municipality; or 2) any officer, employee, or agency of the municipality; and (Ord. 2009-01, 2-4-2009)
         f.   Without a vote of the city council and at any time, and during or outside of a meeting of the city council, but subject to the provisions of subsection 1-5-5A of this chapter, cancel a regularly or specially scheduled meeting of the city council if he deems that there is insufficient reason or workload to warrant or otherwise justify holding said meeting.       3.   The mayor may, with the advice and consent of the city council:
         a.   Assign or appoint a member of the city council to administer one or more departments of the municipality; and
         b.   Appoint a person to fill:
            (1)   A municipal office; or
            (2)   A vacancy on a commission, board, committee, or agency of the municipality.
      4.   The mayor exercises the ceremonial functions for the municipality.
      5.   The mayor may, within budget constraints, appoint one or more administrative assistants to the mayor. (Ord. 2009-01, 2-4-2009)
