5-4-2: EXCESSIVE LIGHT POLLUTION PROHIBITED:
Light from flood lights, spot lights, lasers, work lights, search lights, strobe lights, security lights, porch lights, beacon lights, outdoor string lights or other types of outdoor lighting fixtures or devices which due to brightness, glare, rotation, color, movement or flashing, or its duration, or its location, or the hour when it is illuminated, disturbs the comfort, peace, health or safety of persons in nearby homes or businesses is hereby declared to be excessive and harmful to the health and welfare of residents and visitors to the City of Lava Hot Springs, Idaho. It is unlawful for any person to make, continue, or cause to be made, or allow to be made on any private premises or private business or from any public place or any public right of way or from any vehicle any light which is excessively bright, annoying or offensive to persons in nearby homes or businesses. Provided, however, that persons engaged in events authorized by the City Council in writing, or public works construction, or utility work, or emergency work, or private construction pursuant to a building permit issued by the City, or holiday lighting between Thanksgiving day and January 15 are exempted from the prohibitions of this section. However, for private construction work or holiday lighting to be exempted such lighting may not be utilized between eleven o’clock (11:00) PM and sunrise. This prohibition shall not apply to signs authorized and/or subject to regulation by the Lava Hot Springs Sign Code contained in Title 9, Chapter 4 of the City Code of Lava Hot Springs, Idaho because the illumination from those signs is subject to regulations provided for in the Sign Code.  (Ord. 2020-1, 8-13-2020)
