7-3-6: PERMIT:
   A.   A permit is required in all cases except for a recreational fire, burning inside in a fireplace, wood stove or cook stove. The Lava Hot Springs City Fire Chief, City Code Enforcement Officer, City Clerk or the City Clerk's designee is authorized to issue a permit for burning. The purpose of the permit is to provide a record of the authorized time and target area for the burn and to identify the person responsible for conducting the burn. Obtaining a permit shall not alleviate the permit holder from seeking and obtaining permits from any other agency that has jurisdiction of the target area and/or materials to be burned. All permits are subject to revocation or suspension after issuance at the sole discretion of the Lava Hot Springs City Fire Chief and/or City Code Enforcement Officer if determined that conditions warrant revocation or suspension of the permit. The Lava Hot Springs City Fire Chief, City Code Enforcement Officer, City Clerk or City Clerk's designee shall take reasonable steps to notify the permit holder of such revocation or suspension, but it is the responsibility of the permit holder to exercise due caution and diligence for identifying hazardous conditions before starting a burn. The application and permit shall be in a form authorized and furnished by the Lava Hot Springs City Fire Chief, City Code Enforcement Officer and/or City Clerk. The application and permit shall provide at least the following information:
      1.   The target area of the burn;
      2.   The expected start time and duration of the burn;
      3.   The materials to be burned;
      4.   The name, address and phone number of the person applying for the permit who shall also be the person responsible for conducting the burn;
      5.   The beginning and end date during which the burn is authorized, but in no case shall the authorized dates exceed two (2) weeks from the date of issuance; and
      6.   Any special limits on or conditions applicable to the authorized burn. (Ord. 2017-5, 2-8-2018)
