For the purpose of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
COMMERCIAL ESTABLISHMENT. Any business, medical or industrial establishment, public or semipublic, of any nature or kind whatsoever, other than a single dwelling unit, residential unit or condominium. The term includes, but is not limited to, office buildings, stores, food service establishments, medical facilities and other institutional units.
CONTAINER. Includes, but is not limited to, the following.
(1) BULK CONTAINER. A metal container of not less than four cubic yards capacity, nor larger than eight cubic yards capacity, constructed so as to be water-tight, but with drain plugs at the lowest point of the container to facilitate the drainage of any liquids that might accumulate in the container. BULK CONTAINERS shall be furnished or contracted by the owner or occupant of a commercial establishment.
(2) DISPOSABLE CONTAINER. A non-reusable, water-tight container constructed of plastic, paper or other material used for the storage of liquid materials.
(3) MOBILE CONTAINER. A plastic or metal, water-tight wheeled or carried garbage/refuse container.
CONSTRUCTION DEMOLITION WASTES. Waste materials resulting from the construction or razing of buildings, structures and/or pavements. The term includes, but is not limited to, lumber, paper, plaster and concrete.
GARBAGE. Includes, but is not limited to, customary household refuse generated from a residential dwelling or customary business refuse generated by a commercial establishment:
(1) All wastes resulting from the handling, storage, preparation, cooking, sale or serving of food;
(2) Combustible materials such as paper, cardboard, wood, discarded clothes; and
(3) Non-combustible materials such as metal cans, glass, plastics and crockery. The term does not include human waste.
HAZARDOUS WASTES. Wastes of a solid, liquid or gaseous nature, including hot ashes, pesticides, motor oil, antifreeze, hydraulic fluids, sewage and chemicals which, by reason of their pathological, explosive, radioactive or toxic nature may cause injury or illness to collection and/or disposal personnel.
LANDFILL. A method of disposing of garbage wastes, other than hazardous wastes, on land by placing an earth cover thereon.
LITTER. The visible portion of garbage or refuse which is discarded outside of the regular storage and disposal system.
RESIDENTIAL UNIT. Any freestanding structure or shelter or any part thereof used or constructed for use as a residence for one family.
TRANSFER STATION. A facility used to transfer garbage or refuse from one transportation vehicle to another for transportation to a landfill.
UNAUTHORIZED ACCUMULATION OF GARBAGE. The storage or accumulation of garbage on any premises in the town that:
(1) Creates unsanitary conditions;
(2) Creates fire hazards;
(3) Causes offensive or obnoxious odors;
(4) Provides a breeding or harboring place for insects, snakes, varmints, vermin or other pests; and/or
(5) In any way adversely affects the health, safety and welfare of the public as established by the appropriate and applicable standards of the town.
