G.S. § 160A-312 grants municipalities the power to regulate certain utilities. The town maintains and operates a purchase water system. The town purchases water from the City of Hendersonville. In the event of a declaration of water shortage, the town adheres to the water shortage response regulations set forth by the City of Hendersonville. Any appeals by the town residents or businesses for exception to the restrictions below will be coordinated with, and approved by, the City of Hendersonville following the variances procedures in § 51.30 of this chapter. The town may also declare a water shortage independent of the city if water supply of the town water system is low or declining.
