(A) Upon completion of the work, the Public Works Director of the town shall be notified and shall make an inspection of the site to determine if all conditions have been satisfactorily met.
(B) If the Public Works Director determines that a violation of any portion of this subchapter exists, the person or persons receiving the permit for cutting or excavating shall be notified in writing and ordered to take immediate action to achieve compliance.
(C) If the cause of the violation has not been removed within 15 days of the date of notification, the town may, at its option, remedy the situation and charge all costs and expenses incurred to the responsible person or persons.
(D) If a cut across a road, after patching and initial approval, settles below the level of the adjacent road surface or ground level within a period of 12 months from the date of permit, then the person or persons responsible for causing the cutting or excavating to take place shall be notified in writing and ordered to take immediate action to achieve compliance.
