Existence of a condition which interferes with normal traffic on the street shall be determined by the Chief of Police. Existence of a condition which interferes with maintenance activities on the street shall be determined by the Public Works Director. The fact that the condition which interferes with traffic or maintenance of the right-of-way may have existed prior to the enactment of this subchapter shall in no way be considered as a remedy to the condition.
