(A) The town’s Planning Board, hereinafter referred to as the “Board”, shall consist of seven members.
(B) The appointment and residency of the Board membership shall conform to the proportional representation requirements of G.S. § 160A-362. The Town Council shall appoint the members of the Board from the town. The county’s Board of Commissioners shall appoint the town’s Planning Board members from the town’s extraterritorial jurisdiction. The members appointed by the Town Council shall be residents of the town. The members appointed by the Board of Commissioners shall be residents of the area included in the town’s extraterritorial jurisdiction. If the Board of Commissioners fail to make its appointments within 90 days after receiving a resolution from the Town Council requesting such appointments be made, then the Town Council shall make the necessary appointment.
(C) All seven members of the Board shall have equal rights, privileges and duties regardless of whether the issues being considered and acted upon are in the corporate limits of the town or within its extraterritorial jurisdiction.
(D) The initial appointments to the Board shall be made as follows: four members shall be appointed for a term of three years and three members shall be appointed for a term of two years. Current appointees to the Board shall continue to serve their existing scheduled terms. As the terms of all members expire, members may be reappointed or new members appointed by the Town Council and the Board of Commissioners for terms of two years. If the change in population of the town and/or the extraterritorial area requires that the proportional representation be altered to conform with G.S. § 160A-362, the Town Council and/or Board of Commissioners shall make the requisite new appointments, subject to the closest expiration date of the current Board members.
(E) In the event of a vacancy on the Board, appointee(s) named to complete the unexpired term(s) shall have equal rights, privileges and duties. Members shall serve without pay, but may be reimbursed for any expenses incurred while representing the Board. Regular attendance at the meetings of the Board is considered a prerequisite for membership on the Board. If a member is absent from more than three consecutive meetings, the member may be replaced at the discretion of the Town Council.
