§ 30.01 COUNCIL-MANAGER FORM OF GOVERNMENT.
   This section, in conformance with G.S. §§ 160A-101 and 160A.102, hereby establishes the Council- Manager form of government for the town in accordance with the following.
   (A)   The Town Council may appoint a Town Manager for an indefinite term to serve at its pleasure, in accordance with G.S. § 160A-147, and may fix all contractual terms for the services of the Manager.
   (B)   The Manager shall be appointed solely on the basis of executive and administrative qualifications and will be required to adhere to all tenants of the ICMA Code of Ethics.
   (C)   The Manager need not be a resident of the town or the state at the time of appointment, but must be a United States citizen and shall become a resident of the county as soon as possible.
   (D)   All powers and duties of the Mayor and Commissioners under the Council-Manager form of government shall be as defined by state statute.
   (E)   All powers and duties of the Manager shall be in accordance with G.S. § 160A-148 and are as follows.
      (1)   He or she shall appoint and suspend or remove all town officers and employees not elected by the people, and whose appointment or removal is not otherwise provided for by law, except the Town Attorney, in accordance with general personnel rules, regulations, policies or ordinances as the Council may adopt.
      (2)   He or she shall direct and supervise the administration of all departments, offices and agencies of the town, subject to the general direction and control of the Council, except as otherwise provided by law.
      (3)   He or she shall attend all meetings of the Council and recommend any measures that he or she deems expedient.
      (4)   He or she shall see that all laws of the state, the town charter and the ordinances, resolutions and regulations of the Council are faithfully executed within the town.
      (5)   He or she shall prepare and submit the annual budget and capital program to the Council.
      (6)   He or she shall annually submit to the Council and make available to the public a completed report on the finances and administrative activities of the town as the end of the fiscal year.
      (7)   He or she shall make any other reports that the Council may require concerning the operations of town departments, offices and agencies subject to his or her direction and control.
      (8)   He or she shall perform any other duties that may be required or authorized by the Council.
