§ 90.16 NUISANCES PROHIBITED; ENUMERATION.
   The following enumerated and described conditions are found, deemed and declared to constitute a detriment, danger or hazard to the health, safety or general welfare of the inhabitants of the town and are found, deemed and declared to be public nuisances wherever they may exist and are, therefore, unlawful:
   (A)   Any condition which is or may be dangerous or prejudicial to the public health including, but not limited to, garbage, food waste, animal waste, vegetable matter or any other rotten or perishable matter of any kind that is offensive by virtue of odors or vapors or which may constitute a breeding ground or harbor for rats, mice, snakes, vermin, harmful insects or other pests;
   (B)   Any building or structure which has been damaged by fire, wind, explosion, flood or other causes and found, deemed and declared to constitute a hazard to the health, safety or general welfare of the residents of the town, shall be reconstructed, repaired or demolished in a timely manner as provided:
      (1)   If repairing or rebuilding, repairs or reconstruction shall be initiated within three months of such damage; and completed within one year of such damage; and
      (2)   If damage is such that it is not feasible to repair or rebuild, demolition shall be initiated promptly and the lot returned as closely as possible to its natural state within four months of such damage.
   (C)   Any building or structure which has been found, deemed and declared to constitute a hazard to the health, safety or general welfare of the residents of the town (such as being abandoned and/or in disrepair) shall be abated in accordance with §§ 90.17 and 90.18 of this chapter;
   (D)   The open storage of any item which is or may be dangerous or prejudicial to the public health including, but not limited to, any furniture, appliance, glass or building rubbish which have jagged edges of metal or glass, or have areas of confinement, or may constitute a breeding ground or harbor for rats, mice, snakes, vermin, harmful insects or other pests;
   (E)   An open place of concentration of combustible items such as mattresses, boxes, paper, automobile tires and tubes, garbage, trash, refuse, old clothes, rags or any other combustible materials or objects of a like nature;
   (F)   The uncontrolled growth of grass or weeds on a developed lot to a height of 12 inches or more which may constitute a breeding ground or harbor for rats, mice, snakes, vermin, harmful insects or other pests;
   (G)   Any large amount of cut weeds, grass, bushes, trees, stumps, branches or other material placed along a town right-of-way (except during scheduled town brush collections) not removed in a timely manner by the resident;
   (H)   Any condition which blocks, hinders or obstructs in any way the natural flow of waterways to the extent that the premises are not free from standing water and constitute a breeding ground or harbor for rats, mosquitoes, harmful insects or other pests;
   (I)   An unsecured opening caused by improperly abandoned cistern, well pit, sewage treatment system, unused or non-maintained swimming pool, mine shaft or tunnel; and
   (J)   Improper sewage disposal to such degree that sewage or effluent is discharging onto the surface of the ground, backing up into a structure or discharging into a body of water.
