LATAH COUNTY LAND USE ORDINANCE AMENDMENT
“TODD REZONE”
 
AN ORDINANCE OF LATAH COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF IDAHO, AMENDING THE LATAH COUNTY LAND USE REGULATIONS ORDINANCE #392 CHANGING THE ZONE CLASSIFICATION FOR A 7 ACRE PARCEL OF LAND IN SECTIONS 13 and 18 TOWNSHIP 39 NORTH, RANGES 04 and 05 WEST, B.M., FROM AGRICULTURE/FOREST (A/F) TO RURAL RESIDENTIAL (RR); AND PROVIDING FOR ORDINANCE #400 TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW.
 
   WHEREAS, the Zoning Commission held a duly noticed public hearing on the amendment and thereafter recommended approval to the Board of Latah County Commissioners on May 15th, 2023 and
 
   WHEREAS, the Board of Latah County Commissioners held a public meeting August 1st, 2023 and accepted the Zoning Commission’s recommendation of approval; and
 
   WHEREAS, the procedures required by Latah County ordinances and Idaho Code have been fully complied with;
   
   NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of Latah County, Idaho;
 
SECTION 1:   ZONING MAP AMENDMENT
 
The Latah County Land Use Regulations Ordinance #392, and accompanying maps are hereby amended by changing the zone classification for the parcel described below from Agriculture/Forest (A/F) to Rural Residential (RR), subject to compliance with the plans and specifications as presented to the Latah County Board of County Commissioners. The subject parcel is described as follows:
 
A parcel of land located in Government Lot 2 & 3 of Section 18, Township 39 North, Range 4 West and the Southeast quarter of the Northeast quarter and the Northeast quarter of Southeast quarter of Section 13, Township 39 North, Range 5 West of the Boise Meridian, Latah County, Idaho, described as follows:
 
COMMENCING at the northeast corner of the northeast quarter of the southeast quarter of Section 13, Thence along the north line thereof, N 89°42’42” W, 138.00 feet to the west line of the parcel described in Quitclaim Deed Inst. No. 601927, Latah County records, and the POINT OF BEGINNING:
    Thence along the west line thereof, N 21°10'58" W, 129.78 feet;
Thence continuing along said west line, N 00°49'01" E, 599.50 feet;
Thence leaving said west line, S 61°07'53" E, 385.88 feet;
Thence S 15°35'00" W, 160.06 feet;
Thence S 05°47'35" W, 240.14 feet;
Thence along a curve to the left with an arc length of 174.37 feet, having a radius of 663.84 feet, a chord which bears S 01°43'54" E, 173.86 feet;
Thence S 09°15'23" E, 100.31 feet;
Thence through a curve to the right with an arc length of 58.37 feet, having a radius of 44.84 feet, a chord which bears S 28°02'26" W, 54.34 feet;
Thence S 65°20'14" W, 119.22 feet;
Thence along a curve to the left with an arc length of 157.83 feet, having a radius of 162.89 feet, a chord which bears S 37°34'44" W, 151.73 feet;
Thence S 09°49'06" W, 124.63 feet;
Thence along a curve to the right with an arc length of 101.88 feet, having a radius of 246.45 feet, a chord which bears S 21°39'39" W, 101.16 feet;
Thence S 33°30'12" W, 54.39 feet to a point on the centerline of the County Road (Reams Road);
Thence along said centerline, N 48°42'27" W, 150.58 feet;
Thence continuing along said centerline, N 50°02'32" W, 97.09 feet;
Thence leaving said centerline, N 28°56'12" E, 514.36 feet to the POINT OF BEGINNING,
 
Containing 7.48 Acres more or less.
 
SUBJECT TO the County Road (Reams Road) right of way.
 
SECTION 2:   SEVERABILITY
 
Should any word, clause, phrase, sentence, paragraph, subsection, or other part of this ordinance or any particular application thereof be declared unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.
 
SECTION 3:   EFFECTIVE DATE
 
This ordinance shall take effect and be in full force and effect from and after its passage, approval and publication according to law.
