ORDINANCE NO. 2231

   AN ORDINANCE ENACTING AND ADOPTING AN ADDITIONAL SUPPLEMENT TO THE CODE OF ORDINANCES FOR THE CITY OF LASALLE

   WHEREAS, the American Legal Publishing Corporation of Cincinnati, Ohio, has completed the 2010 supplement to the Code of Ordinances of the political subdivision, which supplement contains Ordinances of a general and permanent nature enacted since the most recent prior Ordinance Number 2163, which Ordinance Number 2163 contained a restatement, codification and compilation in book form of Ordinances in effect as of the 13th day of March, 2006, which present 2010 supplement contains the Ordinances of a general and permanent nature enacted since the prior supplement to the Code of Ordinances of the City of LaSalle through and including the 29th day of June, 2009; and

   WHEREAS, the American Legal Publishing Corporation has recommended the revision or additions to certain sections of the Code of Ordinances, which are based on or make references to sections of the Illinois Compiled Statutes; and

   WHEREAS, it is the intent of the City Council of the City of LaSalle to accept the supplement in compilation and these updated sections in accordance with the changes of the law of the State of Illinois; and

   WHEREAS, it is necessary to provide for the usual daily operation of the municipality and for the immediate preservation of the public peace, health, safety and general welfare of the municipality that this Ordinance take effect at any early date; and

   WHEREAS, this Ordinance is an appropriate exercise of the corporate powers including but not being limited to, the police power, the home rule power and the power to promote the public peace, health, safety and general welfare of the City of LaSalle.

   NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LASALLE, LASALLE COUNTY, ILLINOIS, AS FOLLOWS:

   Section 1: That the above referenced recitals are hereby made a part and portion of the ordained portion of this Ordinance.

   Section 2: That the 2010 supplement to the Code of Ordinance of the Political Subdivision as submitted by the American Legal Publishing Corporation of Cincinnati, Ohio, and as attached hereto, including Ordinances in effect as of the 29th day of June, 2009 be and the same is hereby adopted by reference as if set out in its entirety and shall constitute a further supplement to the Code of Ordinances of the City of LaSalle through and including the 29th day of June, 2009.

   Section 3: That such supplement as provided herein shall be deemed published as of the date of its adoption and approval of the City Council of the City of LaSalle and the City Clerk of the City of LaSalle is hereby authorized and directed to insert such supplement into the copy of the Code of Ordinances kept on file in the Office of the City Clerk of the City of LaSalle.

   Section 4: That this supplement to the Code of Ordinances enacted and adopted herein is declared to be an emergency measure necessary for the immediate preservation of the peace, health, safety and general welfare of the people of this municipality and shall take effect at the earliest date provided by law.

   Section 5: That this supplement to the Code of Ordinances shall be in full force and effect as provided in Section 4 above and such supplement and the City of LaSalle Code of Ordinances shall be presumptive evidence in all courts and places of the Ordinance and all provisions, sections, penalties, and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded and approved and that any public hearings thereof as required by law have been given.

   Section 6: That in the event that any provision of this supplement to the Code of Ordinances and/or any portion thereof should be declared invalid and/or unenforceable for any reason, the invalidity and/or unenforceability  of any such provision and/or portion thereof shall not effect the validity and enforceability of the remainder of the provisions of this supplement to the City of LaSalle Code of Ordinances.

   PASSED AND ADOPTED by the City Council of the City of LaSalle, LaSalle County, Illinois, on this   1st  day of June, 2010, by a roll call vote, with:

  5  Voting AYE; Demes, Bacidore, Green, Ptak, Schroeder

  0  Voting NAY;

  0  PASSING; AND

  3  ABSENT  Lavieri, Salazar, Herndon
