§ 51.09  CONTRIBUTIONS FOR CHECK VALVE INSTALLATIONS.
   (A)   The City of LaSalle does hereby authorize and allocate total sum of $10,000 per year for the purpose of sharing costs between the city and residents for the installation of check valves and/or ejector pumps with a 50/50 split per residence with the city share to be not in excess of $2,000 per residence of the annual budget of $10,000. In the event that the entire $10,000 shall not be used in an individual year, then any balance remaining at the end of the individual year shall lapse as to the prior year's allocation with said balance returned to the Sewer Fund, all subject to the terms and conditions contained herein.
   (B)   For purposes of this section, check valves and ejector pumps are hereby defined as follows:
      (1)   A CHECK VALVE is a device which allows liquid to flow through the device in only one direction; and
      (2)   An EJECTOR PUMP is a pump that replaces gravity during the transportation of waste from a pumping space that is situated underneath the remainder of the system, and a sewage ejector pump lifts waste from the basement or lowest level up to the sewer line where it flows out to a community sewer.
   (C)   This cost contribution in regard to "check valves" and/or "ejector pump" installation program, hereinafter referred to as "program", shall be administered on a first come, first serve basis to be determined within the sole discretion of the City Council based upon recommendation from other city officials, most pertinently including the City Engineer Building Inspector and Superintendent of Public Works, which program shall also be administered on a reimbursement basis meaning that the property owner will be responsible for making the initial payment in regard to all costs and then obtaining reimbursement, if qualified, and provided the other criteria are met, including funds left for a given year. The criteria in regard to selection and qualification shall additionally include the following:
      (1)   Property owner shall be required to provide proof of recent (within the last two years) sanitary sewer back-up. Evidence in regard to meeting this criteria may include, but will not necessarily be limited to, the following: dated photographs, dated video, cleaning bills, records of reports to the city in regard to reporting back-up, amongst other evidence.
      (2)   The property owner shall also have contracted with a plumber and caused to clean and televise the property owner's sanitary sewer service from the residence to the city sewer main to verify that the service is in satisfactory condition. A copy of the video shall be provided to the city through the office of the City Engineer for review. Upon the city being provided the appropriate evidence as required under divisions (B)(1) and (2) above, the city will cause to clean and televise the main sewer in the vicinity of the service connection. A photo log of the connection will be provided to the property owner upon request. In the event that it is ultimately determined that the property owner and property qualifies and is to be a participant in the program, then in that event the cost of this initial inspection can be included with the cost involved in installation of the check-valve and/or ejector pump and thus eligible for partial reimbursement in accord with the other terms and criteria set forth herein.
      (3)   The property owner shall additionally provide to the city through the office of the City Engineer a certified quote from a licensed plumber in regard to the proposed work in regard to the program (i.e., check valve and/or ejector pump) to performed within the city. In the event the City Council based upon the recommendation of the other City Officials including the City Engineer, Superintendent of Public Works and Building Inspector, approves the request, the property owner shall then cause to have the work performed by the licensed plumber and upon providing evidence of the work having been performed and the payment by the owner to the contractor for the check valve and/or ejector pump, which is to be reviewed by the City Engineer and Building Inspector, that in that event, if approved, the property owner will be reimbursed one-half of the cost with the city share again not to exceed the sum of $2,000.
      (4)   Any property owner may be eligible for participation more than once involving the same property; however, in no case shall the total reimbursement for all years and all requests exceed as to that residential property, a city contribution of $2,000.
      (5)   That additionally, no property and/or property owner shall be eligible for participation in this program unless all payments to the city regarding any and all fees and/or charges claimed due to the city have been paid, satisfied and current.
      (6)   Other factors deemed appropriate within the reasonable discretion of LaSalle City Officials.
   (D)   This section shall apply to prospective installations only with the exception of any resident who previously made an installation that would otherwise qualify based upon a written representation of the Mayor that in the event that such a program were ever implemented that said resident would be considered for inclusion.
