(A) Offenders charged under this chapter with the offenses listed in this section, shall be eligible for a prepayment fine, in the amount listed below, in lieu of appearing at an adjudicatory hearing:
(1) For violations relating to building, zoning, and property maintenance and abandoned or inoperable vehicle violations, the prepayment fine is $100.00.
(2) For retail theft violations with a value of items stolen under $20.00, the prepayment fine is $100.00.
(3) For retail theft violations with a value of items stolen between $20.00 and $49.99, the prepayment fine is $150.00.
(4) For retail theft violations with a value of items stolen between $50.00 and $100.00, the prepayment fine is $250.00.
(5) For curfew violations, the prepayment fine is $75.00.
(6) For soliciting without a permit violation, the prepayment fine is $75.00.
(7) For violations relating to open burning, the prepayment fine is $75.00.
(8) For animal related violations, the prepayment fine is $75.00.
(9) For violations relating to the operation of motor vehicles, the prepayment fine is $75.00, except that seat belt violations shall be $50.00.
(10) For violations of the city noise ordinance, the prepayment fine is $75.00.
(11) For violations relating to the possession or use of tobacco products, the prepayment fine is $50.00.
(12) For littering violations, the prepayment fine is $50.00.
(13) For handicapped parking violations, the prepayment fine is the statutorily required minimum fine as established, and as may be amended from time to time, by the Illinois General Assembly.
(14) For snow route parking violations, the prepayment fine is $25.00.
(15) For all other parking violations not referenced in this section, the prepayment fine is $10.00.
(16) For possession of cannabis, the prepayment fine is $100.00.
(17) For possession of open alcohol in public, the prepayment fine is $75.00.
(18) For illegal possession of alcohol by a minor, the prepayment fine is $75.00.
(B) The prepayment of a fine under this section shall constitute an admission of guilt by the person charged.
(C) For the purpose of this section, a “first time offender” shall be defined as a person who has never, at any time, been found guilty of violating any of the offenses subject to this chapter.
(D) Persons charged with an offense not listed in this section and non-first time offenders shall be required to appear at an adjudicatory hearing.
(E) Persons under the age of 18 shall not be eligible for the prepayment option under this section unless agreed to, in writing, by their parent or legal guardian.
(F) The Chief of Police or his or her designee is authorized to establish the procedures for exercising the prepayment option under this section. Said procedures shall be recited on the charging document served under this chapter.
