§ 32.061  CITIZEN DRAINAGE BOARD.
   (A)   The county Citizen Drainage Board is established in accordance with I.C. 36-9-27-1 et seq.
   (B)   The Board established herein shall act in and be known by the name of the county Drainage Board.
   (C)   The county Drainage Board shall consist of five voting members and the County Surveyor, who shall serve on the Board as an ex-officio non-voting member.
   (D)   The five voting members of the county Drainage Board shall consist of the following:
      (1)   One Board member shall be a member of the County Board of Commissioners.  This member shall be appointed to the county Drainage Board by a majority vote of the County Board of Commissioners.
      (2)   The remaining four members shall consist of resident free-holders of the county who are knowledgeable in drainage matters.  These Board members shall be appointed by the County Board of Commissioners.  The Commissioners shall provide geographical balance to the Board by appointing one resident free-holder from each of the three designated districts, as illustrated by the appendix to this chapter, that being a map of the county designating Drainage Districts One, Two, and Three.  The fourth member shall be a resident free-holder and may reside in any of the three districts.
   (E)   The term of those persons appointed to the county Drainage Board shall be for a period of three years, with the initial appointments made so as to provide for the staggering of terms on an annual basis.  As and for their initial appointments the representative from District One shall serve for one year, the representative from District Two shall serve for two years, and the District Three and at-large representatives shall serve an initial appointment of three years.
