§ 94.05  ANIMAL CONTROL ADVISORY BOARD.
   (A)   The LaPorte Animal Control Advisory Board is empowered to establish and collect fees in accord with the following definitions and provisions.
   (B)   Definitions. The following definitions shall apply in the interpretation and enforcement of this section:
      BOARD, as used herein, shall mean the LaPorte Animal Control Advisory Board as provided for in LaPorte County Resolution 89-5.
      ANIMAL CONTROL AGENCY. Any governmental or private entity charged with or contracted with and given authority for the enforcement of the provisions of this section for and on behalf of the county.
      ANIMAL CONTROL OFFICER. The county animal control officer as provided for in LaPorte County Resolution 89-5.
      AUTHORIZED REPRESENTATIVE. An agent in principle of the Board and/or animal control officer.
      PERSON. Any individual, partnership, co-partnership, firm, company, corporation or association.
   (C)   Fees for services. The Animal Control Advisory Board having jurisdiction may charge a service fee not in the excess of the cost for providing to any person, who owns an animal or animal for the care of domestic animals that are under the custody of the LaPorte Animal Shelter, specifically a fee will be charged for shots and various medicines.
   (D)   Collection, accounting and disposition.
      (1)   Collection of fees. The Board shall collect such fees established as a part of this section in accord with the following schedule and accordingly for various medicines:

      (2)   Accounting for fees. All fees collected by the Board shall be accounted for in detail for each service provided.
      (3)   Disposition of fees. All fees collected by the Board shall be transferred to the LaPorte County Animal Control Non-Reverting Fund. The monies collected in accord with the provisions of this section shall be used only for the maintenance of future expansion of the program from which they were derived.
