§ 36.39  HOMESTEAD EXEMPTIONS/CREDITS.
   (A)   This policy is based on I.C. 6-1.1-20.9 et seq. and any subsequent amendments.
   (B)   In the event there is a question regarding the residence of an application for the homestead exemption, the Auditor’s Office may ask the applicant for additional documentation to verify such residence to include a driver’s license and/or a voter’s registration card as well as any other documentation as normally required by the LaPorte County Auditor.
   (C)   In the even of a husband and wife each requesting a separate homestead exemption/credit for two separate properties, the same information may be required as well as a copy of any separation agreement.
   (D)   In the event it has been determined by the county that an individual has filed for a homestead exemption/credit for which they are not entitled and an exemption or credit has been given, the LaPorte County Auditor may maintain an action against such individual to reclaim the value of any exemption or credit given plus a 10% penalty, costs of maintaining the action to include attorney fees and any other statutory penalty that may be available as a result of the filing of such improper homestead exemption/credit.
