§ 34.01  SMOKING PROHIBITED IN/AROUND PUBLIC BUILDINGS.
   (A)   Smoking prohibited in public buildings.
      (1)    For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
         PUBLIC BUILDING.  Any enclosed structure or part of an enclosed structure that is occupied or under the control of the county government.
         SMOKING.  The carrying or holding of any lighted cigarette, cigar, pipe, or other lighted smoking equipment, or the inhalation or exhalation of any smoke from any lighted smoking equipment.
      (2)   All public buildings shall be posted with conspicuous signs that read “Smoking is Prohibited by LaPorte County Ordinance.”
      (3)   All buildings operated by the county government are hereby declared as smoke-free buildings.  Any and all smoking within these buildings is hereby prohibited.
   (B)   Smoking around public buildings prohibited.
      (1)   Smoking is prohibited on the walkway connecting the LaPorte County Courthouse to the LaPorte County Complex.
      (2)   Smoking is further prohibited within 25 feet of any public entrance to any county courthouse or county office building.
      (3)   (a)   Violators of this division (B) will be subject to a fine of $25.
         (b)   Violations of this division (B) by a county employee could subject that individual to disciplinary action to include termination based on repeated violation.
