§ 33.51  FEES AND PERMITS.
   (A)   Fees authorized.  Parks and recreation facilities and programs shall be made available to the public free of charge if possible.  However, if it is necessary in order to provide a particular activity, the Board may charge a reasonable fee.
   (B)   Special use of areas and facilities. 
      (1)   A special use permit must be issued by the Superintendent for other than normal use of any area or facility.  In questionable cases, the Superintendent may refer special use requests to the Board for its consideration and action.  No person or persons, nor any agency, association, organization, or other group, shall be permitted use of any area or facility when that use is intended to be primarily for the purpose of realizing a profit.  The foregoing provision shall not apply to any concessionaire or vendor duly authorized by the Board to sell commodities or services upon park property.
      (2)   Any group offering a park related program to the public may use Luhr Park Nature Center when advance approval has been given.  The program must be limited to a maximum of 30 people.  County Parks Department audiovisual equipment may be used upon request.  A staff employee must be present.  That employee will set up and take down any chairs and/or tables needed for the program.  The user will be responsible for all other setup and cleanup.  The program will end in a timely fashion so that everyone has cleared the park by 10 p.m.
   (C)   Shelter reservations. 
      (1)   Shelter reservations must be made in person, at which time the deposit and the rental fees must be paid to guarantee the requested date.  No date is held until the deposit and rental fees are paid.  A waiver must be signed at the time the fees are paid.
      (2)   All shelter rentals require a $25 deposit.  Rental rates are given in Appendix VII(C) of the Parks and Recreation Policy Manual.  The deposit will be returned two working days after the event. Reservation of shelters may be made up to one year (to the day) in advance.  All persons or organizations will pay the shelter rental fee.  County Parks Department employees and Board members must abide by the shelter rental rules.
   (D)   Recreation pack.  A recreation pack which includes a volleyball, net, bases, bats, balls, and horseshoes may be rented for $15, with a $25 deposit, to county residents only.  The recreation pack may be used on or off county parks property. 
      (1)   The recreation pack will be held for the requested date when the fees are paid. 
      (2)   The pack must be picked up at the Parks Office during normal business hours. 
      (3)   The deposit will be returned upon receiving the recreation pack from the renter.
   (E)   Tree cutting permit.  A sample of the permit is given in Appendix VII(E) of the Parks and Recreation Policy Manual.  The permit is valid for tree removal on the dates and in the specific area listed on the permit, in accordance with park hours, and subject to the following provisions.
      (1)   Wood is to be used for personal home heating and not for resale.
      (2)   The removal of standing trees, dead or alive, is forbidden.  Anyone cutting down, destroying, or removing live wood from Department property will face prosecution.
      (3)   The applicant for this permit agrees to hold harmless the county, the county Parks and Recreation Department, and its employees, in the event of injury while cutting and removing trees and wood.
      (4)   Brush should be stacked, the area kept reasonably clean, and precautions taken so grounds aren’t damaged by tire marks.
      (5)   Falsification of permit, or failure to observe Department rules, will jeopardize future permits.
      (6)   The applicant agrees to remove wood from a specified area.
      (7)   Park staff will meet with the permittee to designate timber to be removed.
      (8)   This permit allows the permittee up to two truck loads of wood.  A truck payload may not exceed a one ton capacity.
      (9)   Permit fee is $10.
   (F)   Vendor fees.
      (1)   All items being sold need to be approved by park staff prior to the event.
      (2)   Charges for vendor permits are:
         (a)   Major food items permit:  $30.
         (b)   Minor food items permit:  $10.
         (c)   Non-food items permit:  $10.
      (3)   The Parks Board reserves the right to adjust vendor fees.
   (G)   Program fees.  For the environmental education program, the fees are:
      (1)   For county residents:  No fee.
      (2)   For out-of-county residents:  $.50 per person.
