10-5-4: SANITARY SEWER AND WATER DISTRIBUTION IMPROVEMENTS 1 :
   A.   Sanitary sewers and water facilities shall be installed in accordance with the standards and specifications as required by the city council and subject to the approval of the city engineer. The use of sanitary sewer ejector pumps for service to individual lots shall not be allowed unless approved prior to installation by the city engineer as a private utility fixture.    B.   Where city sewer and water facilities are not available for extension into a proposed subdivision, the council may permit the use of individual water and sewer systems in accordance with all appropriate state and local regulations. (Ord. 673, sec. 1, 7-17-2000)
   C.   In accordance with the city's comprehensive sanitary sewer plan, as a condition of subdivision approval, subdividers shall pay a sanitary sewer availability charge for the construction of off site sanitary sewer improvements.
      1.   Residential properties will pay the sanitary sewer availability charge prior to approval of the final subdivision approval.
      2.   Nonresidential properties shall pay the sanitary sewer availability charge prior to issuance of the building permit unless the charge can be calculated at the time of final subdivision approval in which case it must be paid at that time. The sanitary sewer availability charge shall be calculated based on subsection 7-5-3-1D of this code.
      3.   Properties which have paid a sanitary sewer area charge prior to December 31, 2005, are exempt from the provisions of this subsection C. (Ord. 802, sec. 1, 3-20-2006)
