(A) Containers. All residents of Residential Dwellings and Owners or managers of multiple-Residential Dwellings and Commercial establishments shall provide one or more containers to receive and collect all MSW, Recyclables, and other materials required by the city which may accumulate between times of collection. The container(s) may be provided by the Hauler.
(B) Dumpsters.
(a) Time Period.
(a) When a property has an active Building Permit, a Dumpster, Flexible Dumpster, or Storage/Shipping Container may be located on private property for the duration of the Building Permit. A Dumpster, Flexible Dumpster, or Storage/Shipping Container must be removed within five (5) calendar days of the expiration of a Building Permit, passage of all final inspections or issuance of a certificate of occupancy, whichever is later.
(b) When a property does not have an active Building Permit, a Dumpster, Flexible Dumpster, or Storage/Shipping Container may be located on private property for up to fourteen (14) calendar days. No person shall keep a Dumpster, Flexible Dumpster, or Storage/Shipping Container on private property longer than the time-frame prescribed in this section without presenting mitigating circumstances for an extension, including but not limited to health conditions and vacating of a home, and receiving approval from the City Administrator/Clerk or City Council.
(2) Regulation.
(a) A Dumpster, Flexible Dumpster, or Storage/Shipping Container may not be placed in the right-of-way, in the line of sight for vehicle traffic at intersections, or on public property.
(b) A property can only have up to either two of the same, or a combination thereof, of the following, at a time: a Dumpster, Flexible Dumpster, and/or Storage/Shipping Container. A property cannot have a Dumpster, a Flexible Dumpster, and a Storage/Shipping Container at one time, two Dumpsters and a Storage/Shipping Container at one time, two Flexible Dumpsters and a Storage/Shipping Container at one time, nor two shipping containers and a Dumpster/Flexible Dumpster at one time. An exemption to this regulation may be allowed by presenting mitigating circumstances for an exemption, including but not limited to health conditions and vacating of a home, and receiving approval from the City Administrator/Clerk or City Council.
(c) A Dumpster, Flexible Dumpster, or Storage/Shipping Container over 40 yards is not Permitted at any time.
(3) Penalties.
(a) Any Person who violates this ordinance shall by guilty of a misdemeanor in accordance with Minnesota Statute 609.02 Subd. 3 as it may be amended from time to time; and the cost of prosecution may be added pursuant to Minn. Stat. § 631.48. This ordinance may be enforced by civil court process, criminal court process, or administrative citation process.
(4) Exemption.
(a) Dumpsters Permitted by a CUP are exempt from this section.
(C) Multiple-Residential Dwellings and Commercial Establishments
(1) For all multiple-Residential Dwellings and Commercial establishments where Solid Wastes must be disposed of and the volume exceeds three 90-gallon containers per week, Dumpster service shall be utilized with the frequency of pick up being not less than once per week. Actual size of the Dumpster or the frequency of pick up shall be determined by need as established by the city.
(2) No person shall deposit Garbage, Bulky Waste, SSOM, Yard Waste, construction/demolition waste or other waste in a Dumpster except the Owner, occupant or authorized agent of the premises using such container. It shall be a misdemeanor in accordance with Minnesota Statute 609.02 Subd. 3 as it may be amended from time to time; and the cost of prosecution may be added pursuant to Minn. Stat. §631.48, to deposit Garbage, Bulky Waste, SSOM, Yard Waste, construction/demolition waste, or other waste in a Dumpster in violation of this section.
(3) All Owners and/or managers of multiple-Residential Dwellings and Commercial Buildings are required to provide containers or Dumpsters for tenants to deposit Recyclables and have adequate storage between collections by a licensed Hauler.
(D) Construction or Demolition Site. At each construction or demolition Site, the contractor and/or property Owner shall provide at least one Roll-Off Container. No Solid Wastes or construction/demolition waste, whether generated at the Site or elsewhere, shall be stored outside the Roll-Off Container. The Roll-Off Container shall be emptied within seven days of the container being filled to capacity. Contractors and/or property Owners shall be responsible for cleaning up and disposing of construction debris carried by the elements onto neighboring property.
