§ 130.03 CURFEW.
   (A)   Between the hours of 9:00 p.m. and 5:00 a.m. during the months of September through May, and between the hours of 10:00 p.m. and 5:00 a.m. during the months of June through August, it shall be unlawful for any minor under the age of 16 years to idle, loiter or be upon the public streets, boulevards, sidewalks, alleys, parks, beach or other public places in the city.

   (B)   The provisions of division (A) above shall not apply when a minor is:
      (1)   Accompanied by a parent, guardian or custodian;
      (2)   Going directly to or from an official school or church sponsored function;
      (3)   Going directly to or from his or her place of employment; or
      (4)   Is traveling for a necessary errand or other legitimate business as directed by a parent, legal guardian or custodian.

   (C)   Except as is provided under the circumstances set forth within division (B) above, it shall be unlawful for any parent, guardian or other adult responsible for the care and custody of a minor child as provided within division (A) above, to allow or permit a minor under the age of 16 years to violate the provisions of division (A) above.
