§ 91.03 PUBLIC PARKS; HOURS AND USES.
   (A)   Hours of use. All public parks and picnic areas (not owned in the name of the state) and all public beaches within the limits of the city shall be open for the use of the general public between the hours of 5:00 a.m. and 10:00 p.m.

   (B)   Unlawful uses.
      (1)   It shall be unlawful for any person or persons to make use of, frequent or be upon any public park or picnic area (except as otherwise provided by state laws) or any public beach located within the limits of the city within the hours of 10:00 p.m. and 5:00 a.m.
      (2)   It shall be unlawful for any person to have in his or her possession or consume any intoxicating liquor upon any public park or picnic area or any public beach of the city, except at such time as any intoxicating liquor, as defined in division (B)(3) below, is being sold pursuant to a special permit issued under the provisions of § 113.048 of the Code and then such liquor may be possessed or consumed only within the area and during the time specifically permitted by such permit.
      (3)   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
         INTOXICATING LIQUOR. Ethyl alcohol and includes distilled, fermented, spirituous, vinous and malt beverages.
      (4)   It shall be unlawful for any person operating a hot air balloon or any other aircraft, to use any public park for an unlicensed landing area, for the purpose of landing or taking off, except as may be specifically authorized by prior written approval of the Park Commissioner of the city. For the purposes hereof, M.S. § 360.55, subd. 6, as it may be amended from time to time, and 14 MCAR § 1.3014 A, B, C and D, are hereby adopted by reference and the provisions thereof shall be applicable and in full force and effect in the city.
      (5)   It shall be unlawful for any person to engage in fishing activities, specifically casting line with hooks, lures or related materials into or upon the waters of Lake St. Croix Beach from the city’s Swimming Beach.
