§ 154.029  WATER QUALITY AND SAMPLING.
   (A)   For any town owned or operated water well that is located within 2,000 feet of a well bore, the town requires, at the operator’s expense, that ground water be sampled and tested. A report of each sampling and testing shall be given to the town within 15 days from completion of same.
   (B)   Ground water samples will be tested pre-fracing to establish a baseline for the water quality of the ground water source(s).
   (C)   Ground water samples will be tested post-fracing.
   (D)   Subsequent water sample testing is to be conducted on a semi-annual basis thereafter for the life of the well to verify that the water source is not impacted by the drilling or production operations. Sampling may be required by the Inspector more often if there is a reasonable basis for believing that same is necessary.
   (E)   Ground water sample testing will be performed by a Texas Commission on Environmental Quality Certified Laboratory.
   (F)   Elements to be measured in ground water samples by laboratory are:
         BTEX (benzene, toluene, ethylbenzene, xylene)
         TPH-total petroleum hydrocarbons
         Chloride, sulfate
         Methane
         Ethane
         Barium
         Calcium
         Iron
         Magnesium
         Manganese
         Carbonate, Bicarbonate
         pH
         Specific conductance turbidity
         Total dissolved solids
         Total suspended solids
         Light gas analysis (C1-C6)
         RCRA 8 metals
         Oil and grease (HEM)
         Total sulfur
         Alcohol scan + 2-Butoxyethanol + Ethylene glycol
   (G)   Water sample test results will be reviewed by the Inspector and/or a technical expert to determine whether the levels of compounds found in the report pose a health risk. If so, the town may impose measures upon the facility to rectify the situation.
   (H)   Within 180 days of its completion date, each oil or gas well shall be equipped with a cathodic protection system to protect the production casing from external corrosion. The Inspector may approve an alternative method of protecting the production casing from external corrosion.
   (I)   All expenses and fees related to the sampling and reports shall be borne by the operator, and shall be paid to the town within 30 days from the date of invoicing from the town.
