(A) After a permit is approved, but prior to any construction or work being performed at the pad site, the town, at the expense of the operator, will retain an independent air quality monitoring company to perform an inspection for air sampling at the location of the well site prior to pad site construction to develop a baseline air sampling report.
(B) Air sampling and testing will be performed by a Texas Commission on Environmental Quality approved laboratory.
(C) The method to be used for sampling and testing of the air samples is Method TO-15 as outlined by the Environmental Protection Agency (EPA) in Compendium of Methods for the Determination of Toxic Organic Compounds in Ambient Air, Second Edition, Compendium Method TO-15, Determination of Volatile Organic Compounds (VOCs) in Air Collected and Analyzed by Gas Chromatography/Mass Spectrometry (GC/MS). (EPA/625/R-96/010b), a copy of which is available at http://www.epa.gov/ttnamti1/files/ambient/airtox/tocomp99.pdf or by request to Town Hall.

(E) After the initial report is given to the town, air sampling and testing will be performed at the well site and a report generated for comparison to previous reports. Such sampling and reports will be performed and given each six months or more often if the Inspector has reason to believe that a need exists for more frequent studies. In addition, such sampling and report will take place within 30 days after any new equipment that may affect air quality or emission is moved onto the pad site.
(F) The town may employ independent third parties to perform the air sampling and give the reports.
(G) All expenses and fees related to the sampling and reports shall be borne by the operator, and shall be paid to the town within 30 days from the date of invoicing from the town.
