§ 154.027  ROAD DAMAGE ASSESSMENT AND FEE AND CALCULATION.
   (A)   A gas well permit shall not be issued for any well to be drilled until the operator has paid a road damage fee, as established by resolution from time to time by the City Council and the most current resolution is incorporated herein for all purposes. The road damage fee shall be paid by the operator to the town prior to the commencement of any activity under the gas well permit. The road damage fee is based on the road damage assessment study prepared for the town and available in the Town Secretary’s office. The road damage fee shall be calculated based on the access lane miles for the appropriate road type, the assessment per lane mile, and the number of lane miles included in each gas well permit application. Replacement costs for asphalt and/or concrete road segments shall be determined from current cost per square yard of road surface material, including installation and labor. In any and all instances, the calculation shall include an estimate of damage during the life of the well that will occur to the roadway after completion that involves traffic on the roadway necessary to produce and /or remove the gas, condensate or peripheral oil or to remove water from the site.
   (B)   A permit shall not be issued to allow re-work of a permitted well using a drilling rig, or to recomplete or fracture stimulate a permitted well after initial completion or to conduct seismic surveys or other exploration activities or to drill a new bore until the operator has paid a road damage fee as established by resolution from time to time by the City Council. The most current resolution is incorporated herein for all purposes. The road damage fee shall be calculated as provided in the above division (A) of this section. In any and all instances, the calculation shall include an estimate of damage during the life of the well that will occur to the roadway after completion that involves traffic on the roadway necessary to produce and /or remove the gas, condensate or peripheral oil or to remove water from the site.
