3.1.4  Subdivider/Developer Agreements.
   It shall be the responsibility of the subdivider/developer to provide, at their own cost, proper access and utilities to each lot in the subdivision as set forth herein. In certain cases, the subdivider/developer may elect to provide additional amenities beyond that which are required by the City. In other cases, the City may elect to participate in infrastructure upsizing to provide service or potential service to more than the affected subdivision. In all cases where streets, utilities or other public improvements are concerned, a written agreement between the subdivider/developer and the City will be required. Such agreement shall delineate the payments to be made by the respective parties, the surety that such work will be performed and the provisions for the perpetual maintenance of such improvements.
