§ 150.04  USE OF WOOD OR WOOD SHINGLES FOR ROOFING.
   (A)   The use of wood shingles, whether specially treated by chemicals or not, and the use of wood that is not covered by fire-resistant material for roofing purposes, on any structure, is hereby prohibited.  No building permit is to be issued for any structure that will have a roof of wood shingles or wood that is not covered by a fire-resistant material.
   (B)   Any structure in existence at the time of passage of this section that has a roof composed of wood shingles or wood that is not covered by fire-resistant material may continue to have its roof in its present condition without violating this section.  At any time that more than 50% of the existing roof surface of the existing structure is to be repaired or replaced, then the entire roof surface shall be replaced by roofing material that is not in violation of this section or any other fire code then in existence.
   (C)   The Town of Lakeside shall issue a notice to any owner, contractor, or subcontractor who is violating this section to immediately cease construction or repair work and shall revoke any building permit issued.  If the work is not stopped after receipt of the notice by the owner, contractor, or subcontractor, then the Town of Lakeside may seek injunctive relief from an appropriate court and recover all attorney fees and court costs incurred by it from any person who has received the notice.  The giving of a cease and desist notice shall not be a prerequisite for the imposition of the penalties hereafter specified.
   (D)   The Town Secretary is hereby directed to publish this section as required by law.
   (E)   This section shall take effect and be in full force from and after the date of its passage and publication as required by law.
