§ 110.01  GARAGE SALES.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      GARAGE SALE.  An offering of used goods and merchandise for sale, exchange, or barter to the public that is set out or displayed in or on a garage, patio, yard, or driveway located in an area zoned for residential purpose and use.
      GROUP GARAGE SALE.  A garage sale whereby property owned by persons other than the owners or occupants of the property where the garage sale is being held is also offered for sale, exchange, or barter.
      WEEKEND.  The period of time running from 8:00 a.m. on a Friday through 6:00 p.m. on the following Sunday.  The time may not be cumulated.  The holding of a garage sale during any portion of a weekend shall be considered as holding a garage sale during the entire weekend.
   (B)   No person or group of persons in the Town of Lakeside, Texas, shall hold a garage sale, except under the following conditions.
      (1)   All the used personal property shall be displayed to possible purchasers only on premises belonging to, or occupied by, the person offering the personal property for sale.  No merchandise or property may be set out or displayed sooner than 12 hours before the weekend during which the garage sale is held.
      (2)   No new personal property may be displayed, offered for sale, sold, bartered, or exchanged.
      (3)   No garage sale may be held until the person who owns or occupies the premises where the sale is to be held obtains a permit from the Town of Lakeside.  The permit shall be obtained at least 24 hours before the garage sale is to be held.  The form and content of an application for a permit shall be established by the town.
      (4)   A fee of $10 shall be charged for the issuance of a permit.
      (5)   The permit must be prominently displayed at the location of the garage sale so that it may be easily and clearly seen from the street fronting the premises where the garage sale is being held.
      (6)   No more than three signs advertising or announcing the garage sale may be posted or displayed off the premises; and no sign may be placed or posted more than 12 hours before the sale begins.  No sign may exceed two square feet in size.  No sign may be posted or placed on town property or right-of-way or on utility poles.  All signs shall be removed within four hours from the time the garage sale ends.
      (7)   No garage sale shall be held for any continuous period longer than one weekend.
      (8)   No garage sale may be held at any one location more than two weekends in one calendar year.
      (9)   The holding of a group garage sale shall be deemed, and considered to be the holding of a garage sale by each participating owner of personal property offered at the garage sale, and thus shall be counted as a garage sale for determining the number of sales held during a calendar year at each persons’ premises.
   (C)   The Town Secretary is directed and authorized to cause publication of this section as allowed by law.
   (D)   This section shall be in full force and effect from and after its publication as required by law, and it is so ordained.
