§ 70.26  EXCEPTION WITH CONDITIONS; VIOLATIONS; FORFEITURE; TERMINATION.
   (A)   If an applicant is granted an exception with conditions, and the applicant violates a condition, the City Secretary or Chief of Police shall send a notice of the violation, with a warning that if any condition is violated again, the exception shall be administratively forfeited and the prohibition shall again be in effect as to the property.
   (B)   If a second violation occurs, then the exception shall be forfeited and withdrawn by giving written notice to the holder of the exception.  The holder of the exception may appeal the forfeiture to the City Council by giving written notice of the appeal no later than 15 days after the date of the notice of forfeiture.  The City Council may overrule the forfeiture, but only if it is found that the two violations did not, in fact, occur.
   (C)   If the exception is forfeited, then the holder thereof may not request another exception for one year from the date the forfeiture becomes final.
   (D)   The exception shall terminate at the expiration of the time set by the City Council, unless the holder shall renew same by filing for renewal thereof.  The procedures and requirements set out above shall apply to any renewal application.
