§ 51.02  DUTIES AND OBLIGATIONS OF RESIDENTIAL CUSTOMER.
   Every residential customer has the following duties and obligations:
   (A)   To provide and use disposable or permanent containers sufficient in number to hold the garbage, trash, brush, and yard waste accumulating on the premises.  A disposable container shall mean any plastic bag or cardboard box with a capacity or volume of 33 gallons or less and which is capable of containing garbage, trash, or yard waste without leaking or emitting odors, and which weighs, when loaded, less than 50 pounds.  A permanent container shall mean a closed, waterproof, plastic, synthetic or metal container or can with a capacity or volume of 33 gallons or less and which is capable of containing garbage, trash, or yard waste without leaking or emitting odors, and which weighs, when loaded, less than 50 pounds;
   (B)   Shall place all garbage, trash, brush, yard waste, and recyclable materials in approved permanent or disposable containers;
   (C)   Shall keep all the garbage and trash containers in use securely closed in such a manner as to prevent the scattering of the contents thereof and to render the contents inaccessible to insects, rodents, and other animals;
   (D)   Shall place brush or trash which cannot be placed in disposable containers or permanent containers into lengths not to exceed four feet and tie same in bundles not to exceed 30 pounds each;
   (E)   Shall place all vines and thorny bushes in appropriate containers;
   (F)   Shall not place for collection, or permit to be placed for collection, any hazardous waste or special waste;
   (G)   Shall drain all water and other liquids from all garbage, yard waste, trash, and recyclable materials before placing same into appropriate containers;
   (H)   Shall place all disposable and permanent containers, recycling containers, and brush at the curbside on the street bearing the residential customer’s address in such manner as to be easily accessible for collection and prevent the garbage, trash, or brush being scattered.  All the containers, brush, yard waste, and recyclable materials shall be placed at the prescribed curbside locations not more than 12 hours prior to the scheduled collection day for pick up.  It is provided, however, that the obligation to place permanent or disposable containers, yard waste, and brush at curbside shall not apply to residential customers that have been designated as handicapped customers by an employee designated by the City Council of the Town of Lakeside to issue the designation pursuant to rules and regulations issued by the Town of Lakeside nor shall same apply to a residential customer who shall have made previous arrangements for the pick up of garbage, trash, yard waste, or brush with the garbage contractor designated by the Town of Lakeside to be responsible for the pick up of same at other than the curbside at the customer’s sole expense in excess of that set herein;
   (I)   Shall remove all permanent containers and recycling containers that are not disposed of by the garbage contractor on a regular collection day from the curbside or front area of the property by not later than 7:00 a.m. on the morning following the regular collection day; and
   (J)   Shall keep all permanent and disposable trash, garbage, and recycling containers out of public view from any roadway that runs in front of the property and shall not store same in front of any building line.
