§ 91.08 ENFORCEMENT; IMPOUNDING.
   (A)   Enforcement. Any dog not licensed as required by § 91.01, or any dog or cat in violation of § 91.05, may be impounded pursuant to division (C) of this section.
   (B)   Animal pound. The Council shall, from time to time, designate a place as city animal pound where suitable arrangements are made for keeping and maintaining any animals which may be seized or taken into custody by any officer of the city pursuant to this chapter.
   (C)   Impounding.
      (1)   Procedure. The police officers of the city or any other person authorized by the city to enforce this subchapter may impound any dog found without the license tag required by § 91.02, any dog or cat harbored or kept in violation of this code, and any dog or cat running at large or otherwise in violation of §§ 91.03, 91.04, or 91.05. Any dog or cat impounded shall be immediately delivered to the poundmaster. The officer shall give written notice of the impounding to the owner of the dog or cat, or if the owner is unknown or cannot be found, he or she shall post notice of the impounding in three or more conspicuous places in the city. The notice shall describe the dog or cat by sex, color, and breed, and shall include a statement that if the dog or cat is not redeemed on or before a specified date, which shall be not less than ten days after giving notice, the dog or cat will be destroyed or otherwise disposed of. The notice shall also state the place where the dog or cat is impounded and conditions for its release.
      (2)   Redemption. Any impounded dog or cat may be redeemed by the owner within ten days from the date of the notice by paying an impounding fee, plus the daily boarding charge for each day after the first day. No unlicensed dog shall be released by the poundmaster unless a license is first procured. A rabid dog or cat may not be redeemed but shall be destroyed immediately.
      (3)   Disposal. Any impounded dog or cat not redeemed within ten days of the notice of impounding may be sold. Any impounded dog or cat not redeemed or sold shall be humanely disposed of by the poundmaster.
