(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
OPERATE. To ride on or upon or control the operation of a skateboard, roller skates, or roller blades.
OPERATOR. Every person who operates or is in actual physical control of a skateboard, roller skates, or roller blades.
ROLLER SKATES and ROLLER BLADES. A form of skate with small wheels or rollers in place of a runner.
SKATEBOARD. A device for riding upon, usually while standing, consisting of an oblong piece of wood or other composition mounted on skate wheels.
(B) Unlawful use. It shall be unlawful for any person to operate a skateboard, roller skates, or roller blades under the circumstances set forth below:
(1) On private property of another without the express permission to do so by the owner or occupant of the property;
(2) In any careless, reckless, or negligent manner so as to endanger, or be likely to endanger, the safety of any person or the property of any person;
(3) On 2nd St. from Liberty St. to Front St. (known as the Downtown Business District) and/or the sidewalk within this area;
(4) During the hours of 30 minutes after sunset to 30 minutes before sunrise, on any public street within the city limits;
(5) The operator of a skateboard, roller skates, or roller blades emerging from an alley, driveway, or building upon approaching a sidewalk or the sidewalk area extending across an alley way, shall yield the right-of-way to all pedestrians approaching the sidewalk or sidewalk area and upon entering any roadway shall yield the right-of-way to all vehicles approaching on the roadway;
(6) Every person operating a skateboard, roller skates, or roller blades upon a roadway shall ride as close as possible to the right hand curb or edge of the roadway; or
(7) No person operating a skateboard, roller skates, or roller blades shall attach the same, or the person of the operator, to any vehicle, other person, or thing in such a manner that the vehicle, other person, or thing to which the attachment is made, can’t control or in any way effect the operation of the skateboard, roller skates, or roller blades in any manner whatsoever.
