§ 24.07 DUMPSTERS AND ROLL-OFF CONTAINERS FOR CONSTRUCTION, DEMOLITION, AND RENOVATION.
   (A)   Provisions for use.
      (1)   No dumpster, roll-off container, or temporary storage unit used in conjunction with construction, demolition, renovation, relocation, or related activity, shall be placed upon any property or within the public right-of-way of the abutting street without a permit therefor issued by the Village of Lakemoor.
      (2)   All such dumpster, roll-off container, or temporary storage unit shall bear an identification number assigned by the state, and the name, address and telephone number of the person responsible therefor.
      (3)   All such dumpster, roll-off container, or temporary storage unit that remains within the public right-of-way during the hours between sunset of one day and sunrise of the next day shall be equipped with suitable reflectors or other warning devices.
      (4)   Rubbish, waste materials, and items to be temporarily stored must be completely contained within the dumpster, roll-off container or temporary storage unit. The accumulation of rubbish, waste materials, or items to be temporarily stored will be not be permitted outside the confines of dumpster or roll-off container, nor will it be permitted to accumulate so that the attached cover cannot be firmly closed. In the event that the dumpster, roll-off container or temporary storage unit does not have an attached cover, the rubbish, waste material, or items to be temporarily stored must not accumulate higher than the top of the sides of the dumpster, roll-off container, or temporary storage unit and must be covered by either a tarp or similar covering, except when rubbish and waste materials are being deposited in the dumpster or roll-off container.
   (B)   Application, permit and fees.
      (1)   Any person desiring to place a dumpster, rolled-off container, or temporary storage unit on a lot/parcel or within the public right-of-way of the abutting street shall make written application therefor to the Village Administration specifying the exact proposed location of such dumpster, roll-off container or temporary storage unit, the size and capacity therefor and any other information as required by the village on the form identified for said purpose.
      (2)   Unless otherwise specified, any permit issued pursuant to this section shall only be valid for a maximum of 90.
      (3)   A permit may be renewed for one additional 90 day period at the discretion of the Board of Trustees for good cause upon written application a minimum of 30 days prior to the expiration of the renewal permit and the payment of a new permit fee.
      (4)   The application for a dumpster, rolled-off container, or temporary storage unit permit that is to be located on private property or within the public right-of-way of the abutting street shall be accompanied by a fee of $25.
      (5)   Each renewal application for a dumpster, rolled-off container, or temporary storage unit permit to be located on private property or within the public right-of-way of the abutting street shall be accompanied by a fee of $25.
   (C)   Refusal or revocation of permit; emergency removal.
      (1)   The Village Administration may, in its discretion, refuse to issue a permit if he deems same to constitute a danger to public safety or an unwarranted interference with the efficient movement of traffic.
      (2)   The Local Code Enforcement and Zoning Official may, in his discretion, revoke a permit if he deems same to constitute a danger to public safety or an unwarranted interference with the efficient movement of traffic.
      (3)   If the Village Administration at any time determines that an emergency situation exists with regard to said dumpster, rolled-off container, or temporary storage unit, the village may remove same without notice at the owner's expense.
      (4)   If a permit is revoked, the dumpster, rolled-off container, or temporary storage unit shall be immediately removed from the property or the public right of way.
      (5)   Upon the expiration of a permit, the applicant shall immediately cause the removal of the dumpster, rolled-off container, or temporary storage unit from the property or the public right-of-way.
   (D)   Violations and penalties. Any person or persons, partnership or corporation who shall violate the terms of this section shall be subject to a penalty of not more than $750 per day, and each day's continuance of the violation shall constitute a separate and distinct violation.
   (E)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      DUMPSTER or ROLL-OFF CONTAINER. A bulk storage container for waste materials that can be hauled directly to the point of disposal or emptied into a large compactor-type truck for disposal.
      RUBBISH. Combustible paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture and bedding dunnage or non-combustible metal, metal furniture, dirt, glass, and crockery.
      TEMPORARY STORAGE UNIT. Portable and transportable storage units that are designed and used primarily for temporary storage of building materials, household goods, personal items and other materials for use on a limited basis on residential property.
      WASTE MATERIALS. Shall include all other categories of materials to be disposed of, excluding garbage or recyclable materials.
