The village, except in cases of gross negligence or willful misconduct while engaged in any emergency management response or recovery activities, while complying with or attempting to comply with the Emergency Management Agency Act, being ILCS Ch. 20, Act 3305, §§ 1 et seq. or any rule or regulations promulgated pursuant to the Emergency Management Agency Act, being ILCS Ch. 20, Act 3305, §§ 1 et seq. shall not be liable for the death of or any injury to persons, damage to property, as a result of such activity.
