§ 4.03 DEPUTY CHIEF/COMMANDER.
   The Deputy Chief position shall be filled by appointment made by the Chief and shall serve at the discretion of the Chief. Such Deputy Chief shall be duly qualified and have not less than ten years of applicable leadership experience in law enforcement. If no qualified candidate arises, the Chief may appoint a Commander, who shall act as, and be subject to, all relevant provisions applying to the Deputy Chief position, until such time as such individual meets the criteria for Deputy Chief. If removed by the Chief, the Deputy Chief, or Commander as the case may be, shall revert to the rank held previously in the Department, if applicable. The Deputy Chief, or Commander as the case may be, shall be allowed to take any promotional examinations that may be held during his or her appointment. This provision shall not be read to allow two positions appointed by the Chief. Rather this provision is intended to specify that either a Deputy Chief or a Commander shall be appointed by the Chief, not both.
