§ 43.26 POSSESSION OF CANNABIS AND DRUG PARAPHERNALIA.
   (A)   Statute adopted by reference. The village hereby adopts by reference ILCS Ch. 410, Act 705, §§ 10 et seq. and ILCS Ch. 720, Act 550, §§ 4 et seq., except as may otherwise be modified herein.
   (B)   Possession unlawful. It shall be unlawful for any person under the age of 21 to possess cannabis or any product containing cannabis within the village. Any person under the age of 21 who is found guilty of violating this section shall be guilty of a civil offense and fined not less than $100 nor more than $200 per offense.
   (C)   Possession of cannabis. It shall be unlawful for any Illinois resident to knowingly possess cannabis or a substance containing cannabis in excess of the following amounts:
      (1)   Thirty grams of cannabis flower;
      (2)   Five grams of cannabis concentrate;
      (3)   No more than 500 milligrams of THC contained in a cannabis infused product; and
      (4)   Registered patients in the medical cannabis program may possess more than 30 grams of cannabis if it is grown and secured in their residence under certain conditions.
   (D)   Possession of cannabis by a non-Illinois resident. Possession limit for non-Illinois residents:
      (1)   Fifteen grams of cannabis flower;
      (2)   2.5 grams of cannabis concentrate; and
      (3)   No more than 250 milligrams of THC contained in a cannabis-infused product.
   (E)   Possession of cannabis prohibited. The possession of cannabis shall be prohibited in the following locations:
      (1)   In a school bus, unless permitted for a qualifying patient or caregiver pursuant to the Compassionate Use of Medical Cannabis Program Act (ILCS Ch. 410, Act 130, §§ 1 et seq.;
      (2)   On the grounds of any preschool or primary or secondary school, unless permitted for a qualifying patient or caregiver pursuant to the Compassionate Use of Medical Cannabis Program Act;
      (3)   In any correctional facility;
      (4)   In a vehicle not open to the public unless the cannabis is in a reasonably secured, sealed or resealable container and reasonably inaccessible while the vehicle is moving; or
      (5)   In a private residence that is used at any time to provide licensed child care or other similar social service care on the premises.
   (F)   Possession of cannabis in vehicles. The possession of cannabis in a motor vehicle is prohibited unless the cannabis is within the allowed amounts stated herein, and such cannabis or cannabis derivative regulated under the Cannabis Regulation and Tax Act is not readily accessible and is within a sealed container.
   (G)   Consumption of cannabis prohibited. No person shall use cannabis at any of the following locations:
      (1)   In a school bus, unless permitted for a qualifying patient or caregiver pursuant to the Compassionate Use of Medical Cannabis Program Act;
      (2)   On the grounds of any preschool or primary or secondary school, unless permitted for a qualifying patient or caregiver pursuant to the Compassionate Use of Medical Cannabis Program Act;
      (3)   In any correctional facility;
      (4)   In any motor vehicle;
      (5)   In a private residence that is used at any time to provide licensed child care or other similar social service care on the premises;
      (6)   In any public place, as defined in ILCS Ch. 410, Act 705, § 10-35; or
      (7)   Knowingly in close physical proximity to anyone under 21 years of age who is not a registered medical cannabis patient under the Compassionate Use of Medical Cannabis Program Act.
   (H)   Operation of motor vehicles. No person shall use cannabis while operating, navigating, or being in actual physical control of any motor vehicle, aircraft, watercraft, or snowmobile while using or under the influence of cannabis in violation of Section 11-501 or 11-502.1 of the Illinois Vehicle Code (ILCS Ch. 625, Act 5, § 11-501, ILCS Ch. 625, Act 5, § 11-502.1), Section 5-16 of the Boat Registration and Safety Act (ILCS Ch. 625, Act 45, § 5-16), or Section 5-7 of the Snowmobile Registration and Safety Act (ILCS Ch. 625, Act 40, § 5-7).
