§ 43.15 BOATING REGULATIONS.
   (A)   Registration and permits.
      (1)   Registration. All boats and vessels shall be required to be registered with the Village Clerk. Proof of said registration in the form of a current registration sticker shall be affixed to the trailer hauling said boat or vessel and be conspicuously displayed on the trailer tongue.
      (2)   Fees. The yearly fee for a non-resident of the village for such registration sticker shall be $30.
      (3)   Special permits. Any regatta or other boating exhibition must be approved by the Village Board a permit for such shall be issued thereafter.
   (B)   Illinois Boat Registration and Safety Act. This section hereby incorporates by reference all applicable provisions of the Boat Registration and Safety Act of the state and amendments thereto, being ILCS Ch. 625, Act 45, and the same shall be enforced as part of this section, except where this section further restricts operations and use of vessels, then this section takes precedence.
   (C)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ICEBOAT. Any boat, vessel or device meant to travel on the frozen waters of Lily Lake on runners, skis or similar devices, powered by sail.
      MOTORBOAT. Any vessel propelled by motor or machine, whether or not such machine is the principal source of propulsion.
      NO WAKE SPEED. The speed at which any motorboat, vessel or device must travel go as not to create any appreciable waves, but in no case shall NO WAKE SPEED be any greater than five mph.
      OPERATE. To navigate, propel or otherwise use a motorboat, vessel or device.
      PERSON. An individual, partnership, firm, corporation, association or other entity.
      POLICE CHIEF. The Chief of Police of the Village of Lakemoor, or any acting Chief, or commanding officer in his or her absence.
      SAILBOAT. Any watercraft propelled by sail or canvas. For the purpose of this section, any watercraft propelled by both sail or canvas and machine or motor shall be deemed a motorboat when being propelled by machine or motor.
      VESSEL or WATERCRAFT. Every description of watercraft used or capable of being used as means of transportation on water.
   (D)   Enforcement. The Village Police Department or any special police or water safety patrol authorized by the village shall, for the purposes of this section, have full and complete jurisdiction of the lake known as Lily Lake for the purpose of enforcement of this section.
      (1)   Designated no wake areas. It shall be unlawful for any person to operate any motorboat at any speed greater than “no wake” in the following areas:
         (a)   Areas known as lagoon and channel; and/or
         (b)   Any area within 75 feet of the shoreline.
      (2)   Maximum speed limits in undesignated areas. In parts of Lily Lake other than areas designated in division (D)(1) above, it shall be unlawful to operate a motorboat or vessel at speeds in excess of ten mph.
      (3)   Nighttime limitations. It shall be unlawful for any person to operate any motorboat at any speed greater than “no wake” between the hours of 9:00 p.m. and 10:00 a.m. on any part of Lily Lake.
      (4)   Muffler and noise requirements.
         (a)   It shall be unlawful to use a boat propelled by a motor or machine unless same is provided with a serviceable muffler or underwater exhaust capable of adequately muffling the sounds of the exhaust of the engine.
         (b)   The phrase ADEQUATELY MUFFLING shall mean that the motor exhaust at all times be so muffled or suppressed as not to create excessive or unusual noise.
         (c)   No other excessive or unusual noise shall be created through operation of said boats or devices.
      (5)   Age requirements. No person under age of ten years shall operate any motorboat or sailboat.
      (6)   Restricted areas.
         (a)   It shall be unlawful to operate any boat or vessel within 50 feet of a bathing area or within any area restricted by buoys.
         (b)   The village may designate certain areas to be bathing, fishing, swimming or otherwise restricted areas. Further, the Village Board or the Police Chief may restrict all boating on the lake when the conditions of weather warrant or when other activities shall have been, approved and boating has been suspended for a particular day.
         (c)   If conditions exist whereby the lake becomes too crowded, the Police Chief may suspend boating on the lake for the remainder of the day.
      (7)   Littering. No person shall be allowed to cast, throw or deposit bottles, glass, caps, garbage, refuse or debris into the waters of Lily Lake or upon its shores.
      (8)   Sailboat size limits. No person shall operate any sailboat upon the waters of Lily Lake that shall exceed 16 feet in length.
      (9)   Iceboat prohibited. It shall be unlawful to operate any iceboat upon the frozen waters of Lily Lake.
      (10)   Hovercraft prohibited. It shall be unlawful to operate any hovercraft or similar air- driven craft on Lily Lake.
      (11)   Horsepower limitation. It shall be unlawful to operate any boat or vessel powered by a motor in excess of ten horsepower.
      (12)   Waterskiing. No boat operating under these provisions shall be used for waterskiing.
      (13)   Reckless operation. No person shall operate any boat or vessel in a careless, willful, heedless, reckless or wanton manner so as to endanger, harass or annoy persons or endanger property.
      (14)   Driving while under the influence. No person shall operate any boat or vessel or be in actual physical control of any boat or vessel who is under the influence of intoxicating liquor and/or narcotic drug.
   (E)   Penalty. Any person violating any part of this section shall be fined not less than $25, nor more than $750, for each offense. Any person who shall be convicted a second time in a calendar year of a violation of this section shall be prohibited from operation of any boat or vessel upon the waters of Lily Lake for the remainder of said calendar year.
